Florida Supreme Court to hear Orlando Resident Mark Daniel Adamczyk v. James L. ?Jack? Hutchings case!

Florida Supreme Court Case SC10-1234 is titled Mark Adamczyk v. Jack Hutchings, but the case number will not tell the story of a three year court battle that has only made Jack Hutchings’ lawyers richer.  Jack Hutchings is not the real name of James L. Hutchings, but he goes by “Jack” to his friends.  He also went by “Jack” to James Adamczyk; Mark Adamczyk‘s father, a relationship that was introduced by the late Wendy’s founder Dave Thomas, and lasted over twenty years. James Adamczyk was Jack Hutchings right-hand man, as Jack Hutchings grew a 400 million dollar fortune with Hutchings Automotive, which supplied tubing and other car parts to General Motors and other car manufacturers.

So, why is the Florida Supreme Court of Florida hearing a case of 29 year-old Mark Adamczyk vs. the old man Jack Hutchings? Well, as time went on, the Hutchings/Adamczyk relationship grew closer, but then came to a screeching halt in November 2007 as James Adamczyk watched Jack Hutchings evade U.S. taxes and fondle underage girls in Hutchings’ mansion at Los Suenos Resort in Costa Rica. Although James Adamczyk wanted out of the twenty year relationship, Jack Hutchings was not ready to let him go. Instead, Hutchings used his power and wealth to diminish James Adamczyk’s bank accounts and forced him into signing over his own Los Suenos Resort Costa Rica property to Hutchings as part of an alleged settlement agreement. Once James Adamczyk returned to the United States from Costa Rica, he reached out to Jack in a friendly manner, and in clairvoyant fashion, asked Jack to settle this situation like men, otherwise only lawyers would get paid in this dispute. Hutchings’ ego wouldn’t dare let Adamczyk tell him what to do, and he quickly sued James Adamczyk for breach of the settlement agreement he forced Adamczyk to sign in Costa Rica. One lawsuit and three years later, Ron Hutchings, Jack’s son almost in tears on the stand at the December 7, 2009 hearing, stated the Hutchings family has spent close to a million dollars in lawyer fees.

Enter David H. Simmons, an Orlando Attorney with DBKSMN.com, and a former State Representative. Simmons’ former clients include convicted felon Lou Pearlman, creator of NSYNC boy band, who is now serving a 25 year jail sentence for fraud. Simmons, almost in the same criminal fashion as Pearlman once dealed, slipped a clause into the settlement agreement stating that any disputes from the forced settlement agreement would be disputed in Seminole County, Florida. Why Seminole County Florida? With a Costa Rica settlement agreement, and Hutchings address of 1818 10th street in Fort Lauderdale, it doesn’t make much sense. However, it makes sense to David H. Simmons, as he quickly had Seminole County Court Judge Nancy Alley rule in favor of Jack Hutchings over James Adamczyk, and of course she quickly recused herself from the case shortly thereafter. So, what does this have to do with Mark Adamczyk and the Florida Supreme Court? In no way is Mark Adamczyk involved at this point. As an innocent bystander, Mark was just watching from the sideline as any family member of Hutchings’ or Adamczyk‘s camp was doing. The only difference is Mark Adamczyk knows how to use a computer. Upon finding out about such technological achievements by Mark Adamczyk, Simmons quickly had Judge Alley make a ruling that the settlement agreement signed by James Adamczyk, now extends to Mark Adamczyk. The ruling states that Mark Adamczyk must refrain from blogging, talking, or putting anything on the web about Jack Hutchings, Ron Hutchings, Wes Hutchings, Richie Hutchings, David Simmons, Thomas Neal, Jeff Elkins or anyone affiliated with Hutchings or DBKSMN law firm. This is a fantastic deprivation of Free Speech while not mentioning that David Simmons is running for Florida Senate District 22. The voters of Florida Senate District 22 won’t even have to vote come November. Why? David Simmons has already won. He shut down Mark Adamczyk‘s political website telling voters to “Vote No.”  He froze Mark Adamczyk bank accounts. As a result, Mark Adamczyk cannot run against Simmons based on the thousand-some dollar entry fee, and cannot afford to market to the voters to not vote for Simmons. Wait - How did Simmons freeze Adamczyk’s bank accounts? Judge Alley, the Judge that recused herself from the case after making oblivious rulings for Hutchings, signed another court order that Mark Adamczyk owes Jack Hutchings $17,000 for missing a deposition - a deposition in which Mark Adamczyk corresponded numerous times that he was unavailable. However, Simmons and Alley would hold courtroom hearings and get orders signed giving Mark Adamczyk notice at 6pm for a next day 9am hearing.

As such, Adamczyk is not in attendance so Simmons makes up ridiculous orders which Judge Alley does not read, but stamps her signature away as easy as a post office clerk would post date your envelopes in line. The oldest trick in the book I’m sure, but Mark Adamczyk couldn’t even begin to afford a lawyer that would be able to stick out three years of litigation. This battle has now lined the pockets of David Simmons and his law firm with over a million dollars from Hutchings, and moreover has had three websites shut down.  Consequently, Mark Adamczyk an innocent victim, can keep fighting his battle pro se, and hopefully will get the Florida Supreme Court to rule that Seminole County Judges are corrupt, the court orders are frivolous, and can stop worrying about being harassed over a contract he never signed. Will Justice be served or will corruption in our Florida courts continue for wealthy individuals? It is now up to the Florida Supreme Court!
